Webshop terms of use

(hereinafter “Terms of Use”)

What is in these terms?

These terms tell you the rules for using the Knorr-Bremse Commercial Vehicle System’s web shop (available at https://mytruckservices.knorr-bremse.com, hereinafter “web shop”).

Who we are and how to contact us

The web shop is an online service operated by Knorr-Bremse Systeme für Nutzfahrzeuge GmbH (hereinafter “Knorr-Bremse”) for you as a contracted Knorr-Bremse distributor and registered customer of Knorr-Bremse. Requirement for the participation in the use of the web shop is that you as our customer are a company with a valid VAT identification number.

By first registration, you accept these terms

By first registration and by using our web shop, you confirm that you accept these Terms of Use and that you agree to comply with them. The use of the web shop and its features is subject to the following conditions. Please read them carefully.


How you become a registered customer for the web shop

For admittance, you must electronically fill in the registration form on our website https://mytruckservices.knorr-bremse.com and send it to us. Any access to online ordering at the web shop first requires the completion of a written, signed addendum to your applicable Knorr-Bremse distributor contract. As soon as the distributor contract and the addendum are signed and returned, Knorr-Bremse will approve of your registration request and activate your account so that you will become a registered customer and can use all features of the web shop hereafter.


We may make changes to these terms

We reserve the right to amend these Terms of Use for valid reasons; in particular in the case that certain legal requirements have to be implemented, the change of jurisdiction requires a clause amendment or market conditions in the industry change. The same applies if an amendment becomes necessary in order to eliminate doubts in interpretation that have arisen. 


You must keep your account details safe

If you register and use the Knorr-Bremse web shop, you are provided with or choose a user identification and a password. Thereafter password changes will be requested every 90 days. You must treat this information as confidential. The distributor agrees to designate an employee as the authorized Company Key User and to inform Knorr-Bremse whenever the designee for this role changes. The Company Key User will be responsible for the set-up and allocation of account holders’ roles within the distributors' organization. The Company Key User is also responsible to deactivate a user identification upon a person leaving the employment of the distributor. You must not disclose your password to any third party. If you know or suspect that anyone other than you knows or uses your user identification or password, you must promptly notify us at webshop.uk@knorr-bremse.com. You agree to accept responsibility for all activities that occur under your user identification and your password. New passwords will only be emailed to the account holder’s email address as shown in the account holder’s profile. We have the right to disable your user identification, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.


How you may use material on our web shop

We are the owner or the licensee of all intellectual property rights on our web shop, and in the material published on it. Those works are protected by copyright laws and treaties around the world, even if they are not labelled as such. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our web shop for your personal use and you may draw the attention of others within your organization to content posted on our web shop.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

You must not use any part of the content on our site for commercial purposes without obtaining a license to do so from our licensors or us.

If you print off, copy or download any part of our site in breach of these Terms of Use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.


We may suspend or withdraw our site

Our web shop is made available free of charge. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of our web shop for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.


Do not rely on information on this site

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action based on the content on our site. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied that the content on our site is accurate, complete or up to date.


We are not responsible for internet access or viruses

We do not guarantee that our web shop will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access our web shop. You should use your own virus protection software.


We are not responsible for websites we link to

Where our web shop contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources. Therefore, we are not liable for illegal, incorrect, or incomplete content or for damages caused by using linked content.


Rules about linking to our web shop

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our site in any website that is not owned by you. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. The Knorr-Bremse Warranty Submission

You understand and agree that the use of the web shop warranty section constitutes claimant's agreement that Knorr-Bremse is given the right to audit claims submitted for consideration, and that any submission is subject to the terms of the applicable Knorr-Bremse product warranty policy (or policies).


The Knorr-Bremse Core Return Submission

You understand and agree that use of the web shop core return section constitutes the sender’s agreement that Knorr-Bremse is given the right to audit core returns submitted for consideration, and that any core return submission is subject to the terms of the applicable Knorr-Bremse core policy (or policies).


The Knorr-Bremse Terms & Conditions of Sale

You understand and agree that if you purchase goods from our web shop, the terms and conditions of your Knorr-Bremse distributor contract, which shall govern any Knorr-Bremse products, will apply to the sales. If a valid and existing distributor contract is not in place for any reason, then any product sales shall be subject to the Knorr-Bremse Terms and Conditions of Sale.


Our responsibility for loss or damage suffered by you

We accept liability for the content of this web shop in accordance with the law. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We exclude all implied conditions, warranties, representations or other terms that may apply to our web shop or any content on it. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use our web shop or use of or reliance on any content displayed on our web shop.

In particular, we will not be liable for loss of profits, of sales, of business or business interruption, loss of anticipated savings, loss of business opportunity, of reputation, or any indirect or consequential loss or damage.


How we may use your personal information

Knorr-Bremse is sensitive to privacy issues on the Internet and is committed to protecting your privacy on our websites. We take precautions to keep all information obtained from our online visitors secure against unauthorized access and use, and we periodically review our security measures. We have established the following guidelines to explain the way in which we use information gathered from visitors to our websites:

Forms that you fill in to interact with Knorr-Bremse may request that you give us information such as your name, e-mail address, mailing address or telephone number. Whenever that is the case, we will establish a secure connection with your web browser. Please note, you must be 16 years or older to submit any personal information to this site. Knorr-Bremse may use information gathered through forms on the site for its own communication or marketing purposes, but will not sell, distribute, or lease your information to third parties unless we have your permission, or we are required by law to do so. Note that our Websites contain links to other third-party websites. Although we reasonably attempt to link only to websites that share our concern for customer information privacy, we are not responsible for their content or their own privacy practices. Furthermore, we will only use your personal information as set out in our data protection declaration for the processing of data.


Which country's laws apply to any disputes

Should disputes of a legal nature arise from the use of the information contained in this catalogue, these shall be subject exclusively to the rules of German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Should any provision of these Terms of Use, or any provision incorporated into these Terms of Use in the future, be or become invalid or unenforceable, the validity or enforceability of the other provisions of these Terms of Use shall not be affected thereby.
